If I have health insurance to pay my medical bills, do I still have a case against the person at fault?

Yes. However, some health insurance providers (Medicaid; Medicare; Champus; self-funded ERISA plans; worker’s compensation) are entitled to at least partial reimbursement from your settlement.  However, many times the amount that you have to pay back to your health insurance company is less than the amount of the original bill.
